1. Data We Collect and Its Purpose
Ajrni collects the user data necessary to operate the platform, such as registration data, identity-verification data, payment data (through the licensed payment provider) and usage data. This data is processed on the basis of performing the contract with the user, complying with a statutory obligation, Ajrni's legitimate interest in operating the platform and protecting it from fraud, or the user's explicit consent in the cases where the law requires it.
1.1 Rights of the Data Subject
Every user has the right, under the Personal Data Protection Law, to request: access to their personal data held by Ajrni; correction of any inaccurate data; deletion of their data (subject to the statutory exceptions, such as accounting and tax records that must be retained); and a copy of their data in a portable format. These requests are submitted through the "Contact Us" section, and Ajrni undertakes to respond to them within the statutory time limits.
1.2 No Sale or Sharing of Data with Unauthorised Parties
Ajrni will not sell, rent or trade any personal information of users to a third party outside the platform or its affiliates for marketing purposes, except with the user's prior written consent, or where the data is aggregated/statistical and does not allow any individual to be identified.
1.3 Sharing Data with Operational Partners
Ajrni may share limited data (such as name, contact number and delivery address) with delivery partners or payment or insurance service providers, solely for the purpose of executing the transaction requested by the user, and under agreements that oblige these partners to protect the data to standards no lower than those applied at Ajrni.
1.4 Mandatory Disclosure
Ajrni may be required to disclose personal data to the competent governmental or judicial authorities where this is required under an applicable law or a court order, and in such a case Ajrni will limit the disclosure to the minimum data necessary.
1.5 Information Security
Ajrni is committed to applying reasonable technical and organisational controls to protect users' data from unauthorised access, use or disclosure. In the event of any breach affecting personal data, Ajrni undertakes to notify the competent authority and the affected users in accordance with the time limits and procedures set out in the Personal Data Protection Law and its implementing regulations.
1.6 Amendments to the Privacy Policy
Ajrni reserves the right to amend this policy when necessary. Any material amendment will be published on the privacy-policy page, and users will be notified of it before it takes effect.
1.7 Data Retention Period
Ajrni retains the user's personal data for as long as their account on the platform remains active, and for the additional period necessary after the account is closed to fulfil the purposes for which the data was collected, to establish and defend rights before the competent judicial or regulatory authorities, or to meet a statutory obligation that imposes a specific retention period (such as accounting and tax records, which are kept for the periods required by the laws in force in the Kingdom of Saudi Arabia). Once the purpose of retention has ended and no statutory obligation remains, Ajrni undertakes to delete, destroy or anonymise the data in accordance with the Personal Data Protection Law and its implementing regulations.
1.8 Advertising Measurement Partners
To measure the effectiveness of our advertising, Ajrni shares limited information with advertising measurement partners, currently Snap Inc. (Snapchat Conversions API). What we share: your phone number and email address only as irreversible SHA-256 hashes (never in readable form), your device's advertising identifier (only where you have granted tracking permission on iOS, or on Android where available), a per-install app identifier, your IP address and app/device details, and in-app activity such as sign-up, searches, listing views, reservations, payments and listing publications. Why: to attribute sign-ups and rentals to the advertisements that led to them and to optimise our campaigns. This sharing is governed by Snap's own privacy policy. You can withhold the advertising identifier at any time through your device's tracking settings; hashed identifiers cannot be used by the partner to contact you.
2. Comments and Ratings
• Users may write a rating of the item or of the other user they dealt with, after the transaction has actually been completed.
• Ratings are displayed publicly, and Ajrni may remove any rating it considers to be in breach of these terms.
• Ratings must not contain racist, abusive, threatening or intimidating language; otherwise Ajrni is entitled to delete them and take the appropriate action.
• Users are prohibited from posting advertising or marketing material within ratings.
• Users may not share personal contact information (name, phone number, email) with third parties through the ratings field.
• A user who receives a negative rating, or content they consider inaccurate, may respond to it publicly through the dedicated reply feature on the platform (where available), or submit a review request to Ajrni together with evidence that the rating is inaccurate or breaches the rules of this clause. Ajrni undertakes to examine the request and take the appropriate decision (to keep or delete it) within a reasonable period and according to published objective criteria, without this constituting an obligation on its part to verify the accuracy of every rating before it is published.
3. Technical Security and Cookies
• Ajrni does not guarantee that the site or the downloadable files are entirely free of viruses, but it undertakes to take reasonable security measures to reduce this risk. To the extent permitted by law, Ajrni is not liable for damage caused by viruses that did not result from its direct negligence.
• Ajrni uses cookies to improve the user experience, increase security and measure the effectiveness of the platform, without these files directly revealing personal information. The user can control them through the browser settings.
• The platform may contain links to external sites whose privacy practices Ajrni is not responsible for; users are advised to review those sites' policies independently.
4. Downloadable Materials
• Downloadable materials are provided on the basis that the user runs the necessary virus checks to protect their data and device.
• Ajrni is not liable for any loss or damage arising from the use of downloaded materials, unless its direct negligence in providing them is proven.
• If the user shares these materials with another party, they undertake to inform that party of these terms.
5. Final Provisions
5.1 Governing Language
The Arabic version of these terms is the official and legally binding version. Any versions translated into other languages are provided for convenience only, and in the event of any conflict the Arabic version shall always prevail.
5.2 Governing Law and Jurisdiction
(1) These terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.
(2) If a dispute arises between a lessee and a lessor concerning a particular transaction, Ajrni may offer non-binding mediation to both parties to help them reach a resolution, without this giving rise to any liability on Ajrni in its capacity as an intermediary that is not a party to the transaction.
(3) If any direct dispute arises between the user and Ajrni out of these terms, the competent judicial authority in the Kingdom of Saudi Arabia (such as the competent commercial courts in the city of Ajrni's head office) shall have jurisdiction to settle it, unless the parties agree in writing to settle the dispute by arbitration; in that case the dispute shall be referred to arbitration at the Saudi Center for Commercial Arbitration (SCCA), administered under its rules in force at the time the request for arbitration is filed, with the seat of arbitration being the city of Ajrni's head office and the language of arbitration Arabic, unless the parties agree otherwise in writing.
5.3 Entire Agreement
These terms and conditions, together with the privacy policy attached to them, constitute the entire agreement between the user and Ajrni regarding the use of the platform, and supersede any prior agreements or understandings.
5.4 Severability
If any term of this agreement becomes invalid or unenforceable under a final court ruling, this shall not affect the validity or enforceability of the remaining terms, and the agreement shall remain in full force with all its remaining provisions.
5.5 No Waiver
No term of these terms and conditions may be waived except with the express written consent of both parties. Ajrni's failure to exercise any right set out herein shall not be deemed a waiver of that right.
5.6 Complaints and Contact
For complaints relating to the service or its performance, please write to: info@ajrni.sa
For enquiries or suggestions, you can contact us through the "Contact Us" field within the platform.
5.7 Notices
• Notices from Ajrni to the user under these terms are sent by email to the address registered in the user's account, by a notification within the platform or the app, or by a text message to the registered mobile number, as Ajrni deems appropriate to the nature of the notice.
• A notice is deemed to have reached the user and to be effective against them once it is sent by any of the above means to the latest contact details the user registered with Ajrni. The user alone is responsible for keeping their contact details up to date, and Ajrni is not liable for a notice not being received because the user failed to update their details.
• The user's notices or official correspondence to Ajrni are directed through the "Contact Us" section within the platform, or to the email address designated for complaints set out in clause 24.6, and Ajrni undertakes to respond to them within a reasonable period.
